Agreement

This End-User License Agreement (EULA) is a legal agreement between you (either as an individual or single entity) and the PERSPEQTIVE GmbH (referred to as "PERSPEQTIVE"). By installing, copying or using the SVN-Connector for Jira by the PERSPEQTIVE for the Atlassian platform, you agree to be bound by the terms of this EULA. This license agreement represents the entire agreement concerning the program between you and PERSPEQTIVE, and it supersedes any prior proposal, representation, or understanding between the parties. If you do not agree to the terms of this EULA, do not install or use the SOFTWARE PRODUCT.

This EULA is a supplement to the Atlassian Marketplace Terms of Use.

Warranties

PERSPEQTIVE expressly disclaims any warranty for the SOFTWARE PRODUCT. The SOFTWARE PRODUCT is provided 'As Is' without any express or implied warranty of any kind, including but not limited to any warranties of merchantability, noninfringement, or fitness of a particular purpose. PERSPEQTIVE does not warrant or assume responsibility for the accuracy or completeness of any information, text, graphics, links or other items contained within the SOFTWARE PRODUCT. PERSPEQTIVE makes no warranties respecting any damages that may be caused by the use of this product. The definition of damages under this provision include, but are not limited to, indirect or consequential damages, any loss or damage arising from loss of data, and any lost profits arising out of or in connection with the use of this add-on.

Copyright Protection

The software 'as is' is intellectual property of PERSPEQTIVE. No copies of third party dependencies are involved.
If you believe, your work or copyright has been violated or was inproperly used, we strongly encourade you to contact us via email.

Data Access

By using this add-on and installing the perspeqtive-svn-connector-for-jira.phar executable, you allow legally the add-on to access the Subversion repository to which you ask the add-on to use. Neither the excecutable, nor any of the procedure involved in the development and testing will access the subversion files or data. The only requests to your Subversion repositories are queries for meta data of commits, their date, authors, comment and subject with the appropriate rights setup by you.

No personal data is ever submitted to PERSPEQTIVE or any of our partners.

The repository commits meta data are submitted directly to the Atlassian platform and thus can only be accessed by the platform operator.

Severability Clause

The holding of any provision of this Agreement to be invalid or unenforceable by a court of competent jurisdiction shall not affect any other provision of this Agreement, which shall remain in full force and effect. If any provision of this Agreement shall be declared by a court of competent jurisdiction to be invalid, illegal or incapable of being enforced in whole or in part, such provision shall be interpreted so as to remain enforceable to the maximum extent permissible consistent with applicable law and the remaining conditions and provisions or portions thereof shall nevertheless remain in full force and effect and enforceable to the extent they are valid, legal and enforceable, and no provisions shall be deemed dependent upon any other covenant or provision unless so expressed herein.
